2. Acceptable Use

You agree to use our Services in accordance with all applicable laws and regulations, including but not limited to:

You must not use our Services for any illegal, abusive, or unethical activity, including unsolicited bulk messaging, harassment, fraud, or infringement of intellectual property.

3. Messaging & SMS Terms

If you use our Services for messaging or SMS campaigns:

All recipients must provide prior express consent to receive messages.You must maintain records verifying opt-in consent.Messages must include clear opt-out instructions, such as “Reply STOP to unsubscribe.”You must disclose that “Message and data rates may apply.” Message frequency should align with what users were informed of during opt-in.

We do not guarantee message delivery. Carriers and Fynl.io are not responsible for delayed, undelivered, or misdirected messages.

4. Client Responsibilities

As a user of our Services, you agree to:

Provide accurate and lawful data and contentObtain all necessary legal permissions, consents, and rights to use the information you uploadAbide by industry best practices when communicating with leads or customersUse the Services in good faith and not for deceptive or unlawful purposes

5. Payment Terms

Payment terms are outlined in your service plan, invoice, or agreement. Key points include:

All fees are due as agreed; late payments may result in suspension of services.We reserve the right to charge late fees and/or restrict access to your account.All sales are final unless otherwise agreed in writing.

If your account is past due, we may also pursue collection and charge any associated fees.

6. Intellectual Property

All custom work produced by Fynl.io, including graphics, content, campaigns, and strategies, remains the property of Fynl.io until full payment is received. Upon full payment, you may be granted rights to use specific deliverables as agreed in writing.

Software platforms, templates, and automations provided via third-party white-labeled tools remain the intellectual property of their respective providers.

7. Confidentiality

Both parties agree to maintain the confidentiality of all non-public, proprietary information disclosed during the engagement. This includes client lists, account details, campaign strategies, and pricing structures.

Confidential information may not be disclosed unless required by law or with prior written consent.

8. Limitation of Liability

Fynl.io provides all Services “as is” without warranties of any kind, whether express or implied.

To the maximum extent permitted by law, Fynl.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost revenue, profits, or data, resulting from your use or inability to use the Services.

9. Termination

We reserve the right to suspend or terminate your access to the Services at any time for any reason, including but not limited to:

Upon termination, all outstanding fees are immediately due. You must also cease all use of our platform, proprietary materials, and tools.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the

State of California, without regard to its conflict of law principles.

We may update these Terms periodically. Any updates will be posted on this page and are effective immediately upon posting. Continued use of the Services after changes constitutes your acceptance of the new terms.
